AGREEMENT

By reading this document and showing intent of commissioning me, you agree to the following:

  1. terms and conditions outlined on this page

  2. keep in contact with me and provide feedback or acknowledgement every time an update is sent

  3. you ensure that you are above 18 and have enough funds to purchase digital goods, preferably money that you have earned yourself

  4. absolutely not file for PayPal disputes and chargebacks and agree to contacting me first for refunds and corrections on your commission

COMMISSION PROCESS

  1. Slots are granted through submitting an application for a posted Google Form or inquiring through Rigger Mortis. Commission slots aren't guaranteed and potential clients are discouraged from submitting an application if they cannot wait for the results. If applications open, they usually last for 2 weeks.

  2. Applicants who are granted a commission slot will be contacted via email and Twitter.

  3. Clients will be given a quote for their commission in the form of a PDF.

  4. Clients are expected to pay the 10% waitlist fee within 48 hours of confirming their slot and the quoted price. The remaining 90% will be paid when I will start working on their commission. Please note that the waitlist fee is non-refundable.

  5. Payments can be made through invoice via PayPal or wire transfer or direct transfer through Wise. Clients will be given a 10% discount if Wise is used as a payment method and they may ask the artist for help in setting up a Wise account.

  6. The client may opt to pay in full to get the most updates and services such as test models. Payment plans can be discussed.

  7. The client will be given a document to sign as proof of hiring the artist. This document will be used for when the artist's bank asks for verification for transactions as well as proof of work to be submitted to the artist's university.

  8. The client will be given access to their own project tracker that shows the commission timeline and records all the feedback and revisions made on the model.

  9. Updates for the commission will be sent through Discord directly from the artist or through contact persons if the project is accepted under Rigger Mortis. Updates may come in the form of pictures, videos, or test models. This section describes when test models will be sent as well as details about revisions.

  10. The commission is considered done once the final work has been delivered and client has given approval or if the client hasn’t replied within 48 hours.

Commission Timeline

  1. Commissions will be delivered within 4 months of me starting the commission. If the commission has a specific deadline, clients are encouraged to inform the artist.

  2. A project that has a deadline of less than 4 months is considered as a rush or special order. Rush orders will incur a fee of 30% of the commission order.

Deadline extensions

  1. If the artist ever fails to meet the deadline for the commission, she will be contacting the client as soon as possible to state the reason for an extension.

  2. If the client refuses the deadline extension, the artist shall be issuing a refund.

Additional Fees

The client will be charged additional fees when:

  • there are already too many revisions (price will be discussed).

  • the model has more expressions and animations than what is offered as free (price included in quote).

  • the commission is a rush order (30% of commission total).

  • the client wants to secure a slot without having to wait for commissions to open or go through an application (30% of commission total).

  • they want the commission to be private (15% of commission total).

privacy terms

  1. The client’s / payor’s and the artist's legal name, country of origin, and other personal details may be known to both parties during the commission process, specifically during payment via wire transfers or transaction performed using a non-business account on PayPal or Wise.

  2. The client / payor and artist agree to not share any personal information about the artist, unless it's for legal purposes like disputes and the artist needing to provide proof of work for underloading in university.

refund policy

Please note that the waitlist fee is non-refundable (with an exception found below). As mentioned in the commission process section, the waitlist fee is 10% of the commission price.A refund can be issued when:

  • the client is HIGHLY DISSATISFIED with the commission.

  • the client has paid in full and has requested a refund before I could work on the commission.

  • the client's commission has been terminated by the artist.

  • the artist cannot fulfill the commission by the given deadline and was denied a deadline extension.

The refund wil be issued after I have discussed the final refund amount with the client. More details below. The refund will be sent through the same payment method as what has been used by the client to pay the artist. Any transaction fee will be shouldered by the client.


The client will be refunded

  • no more than 40% of the total commission price if head XY and/or body XY is done.

  • no more than 70% of the total commission price if only mouth, eyes, eyebrow, and body Z head Z parameters are done.

  • 90% of the total commission price if the client wishes to cancel their commission after paying in full and no work has been done yet.

  • 100% of the total commission price if the artist cannot complete it due to grave reasons such as hospitalization.


A refund CANNOT be issued when

  • the commission is at the physics rigging phase, unless the artist decides to terminate the commission.

  • 2 weeks have passed since the commission was delivered.

  • 2 weeks have passed since I have made corrections and revisions to the final work.

  • the client has neglected to give feedback or acknowledge progress despite having been sent updates or having access to the progress via livestreams and archives but did not comment on the progress or claim to not have seen said progress.

  • the client has untruthfully expressed satisfaction.

  • the client has intentionally kept negative feedback and request/s for corrections to themselves during the whole commission process.

  • the client needs the money back for other expenses.

The commission will be terminated after the refund. If the client decides to commission me again, they will have to pay full price.

Revisions, updates, and client feedback

Live2D Model Updates
The client will be sent test models 3 times during the commission process, when the following have already been rigged: (a) eye blinking and mouth, (b) head angles (with physics), and when the rigging is almost done.
Please note that the complete set of test models will only be sent to the client if they have paid in full. Clients who avail of a payment plan will only be sent the first test model.For clients who have paid in full, the artist will also send video updates of the model movement as much as possible to give the client a chance to provide feedback and make sure that the model suits their preferences. For clients availing of a payment plan, the frequency of updates will depend on how spread out the payments are. Please consult with the artist to come to terms with an agreement on updates and payment.Illustration Updates
For illustrations, the client will be sent updates during (a) the sketch phase, (b) base color phase, and (c) during rendering phase. The artist will also send updates for how much work is done after every workday.
When are revisions free?
First and foremost, the client is encouraged to provide any kind of feedback during the commission process to ensure that the model is of high quality.Minor revisions are free but there is a certain arbitrary threshold for the quantity of minor revisions. The artist will make sure to inform the client if their free revisions are almost up. Once the artist hasinformed the client that they have used all of their free revisions, the artist shall propose a price for additional minor revisions.
Major revisions before and after delivering the completed work are not free. For minor revisions after delivery of the final work, please consult with the artist since it may be free. The client may also consult with the artist to determine if the desired revision is considered minor or major.
What are considered as major revisions?

  • change of clothes

  • additional animations

  • additional expressions

  • changing animations

  • change of more than 10% of the model's layers.

  • revising already done parts, with the exceptions of small preferences in rigging and mistakes made by the artist.

If the revision you're thinking of isn't in this list, please consult the artist.Client's Role and Etiquette

  1. The client is expected to check for mistakes in rigging such as clipping, displacement of parts, and any general mistakes in rigging that are obvious and greatly lowers the quality of the model.

  2. The client should also provide all of their feedback within 48 hours of receiving an update from the artist. This is to help save time and make the commission process more efficient.

  3. When giving feedback, it is highly encouraged to be detailed and that desired corrections to be requested are final. This is to save time and ensure that all efforts are meaningful.

  4. Please do not micromanage the artist.

What type of feedback is not allowed?

  • requesting for changes that are out of control of the artist (ex. asking for changes in illustration when you have availed for a rigging-only service)

  • micromanaging

  • wanting to be particular but requesting a revision without clear ideas, proper references, and direction

  • being too fickle about changes ex. requesting for multiple changes and making the artist undo them for more than five times

intellectual property and commercial use terms for Live2D Models

Client

  1. The client should give credit to the artist in their social media biographies and Twitch and/or YouTube channel descriptions. ex. パパ: Kira Omori , Rigger: Kira Omori. The credits should be easily seen and not purposefully hard to get to.

  2. The client may use the model for the following commercial purposes: (a) streaming and (b) social media graphics. Other types of commercial use would need permission from the artist.

  3. The client may not use the work produced by the artist for NFT or crypto related works and/or activities.

  4. If the artist was the one who had illustrated and/or designed the model, the client is not allowed to use the Live2D illustration for merchandise. An additional fee will be charged in order to be granted this specific right.

  5. If the artist was hired only for rigging services, the client may ask for help in posing the model for other commercial purposes besides streaming and social media graphics.

  6. Regular clients WON'T be receiving the original and editable Live2D file, only the files ready for facial tracking. Corporate clients are able to obtain the editable Live2D file, but require a fee.

  7. The client is not allowed to request for the .cmo3 file in order to make changes or updates to the model, unless they are a corporate client. The client will only be allowed to have the model updated if the new rigger or illustrator is a member of Rigger Mortis.


Artist

  1. The artist has the right to use the work for their portfolio, promotion of commissions, and posting of WIPs. Disallowing the artist from streaming or posting anything about the commission will incur a fee that is decided on how private the commission will be. The fee makes up for lost marketing and inquiries.

  2. If the artist has illustrated and rigged the model, they have the right to resale. This is applicable in the event that the client does not desire to use the model any time during the commisson process and 1 month after delivery, has filed a chargeback, or if the client decided to not continue with the commission in the middle of the process. The artist also has the right to modify the model in order to make it fit for reselling.

  3. The artist may modify the model in any way when providing model updates for a client. These updates may include changes in textures, clothing changes, facial feature updates, and hair changes.

  4. The artist is allowed to reuse textures which are which are common to all models e.g. background effects, glasses, accessories.

  5. The artist is NOT allowed to reuse textures drawn by another artist.

  6. The artist is NOT allowed to modify and resell an already completed model commission if the client has given approval after delivery.
